Terms and Conditions

1. Information regarding gifts and how to claim forms part of these conditions. By claiming, claimants accept these conditions.

2. Offer is open only to Australian residents except directors, management and employees (and the immediate families of directors, management and employees) of the Promoter, of the Participating Stores, of or of the agencies or companies associated with this offer. Offer is not open to New Zealand residents.

3. Offer valid from 14 September 2011 and ends at close of business on 19 October 2011, or until gift stocks are exhausted, whichever occurs sooner (Offer Period).

4. During the Offer Period, this offer will only be conducted at participating Priceline stores in Australia (Participating Store).

5. This offer entitles bearers of the coupon to a free Maybelline NY Eyestudio Lasting Drama Gel Liner, valued at $16.95 (inc GST). To redeem this offer, readers must, fully complete the coupon located in the October issue of Dolly Magazine including by providing their name, address and email address, take the completed voucher to a Participating Store, and surrender their original coupon to a staff member. Limit of one claim per claimant per day.

6. Gifts and coupons are not transferable or exchangeable and cannot be redeemed for cash. Gift value is the recommended retail price of the gift. The Promoter accepts no responsibility for any variation in gift value. If a gift is unavailable for any reason, the Promoter may substitute for that gift another item of equal or higher value as determined by the Promoter.

7. Coupons cannot be used in conjunction with any other offer. Only original coupons will be accepted as valid. Partial, reproduced or damaged coupons, and any coupons obtained by or through fraud or other illegal activity, are invalid.

8. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

9. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this offer or accepting or using any gift, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

10. The Promoter is not liable for any tax implications arising from receiving any gifts. Independent financial advice should be sought. Where this offer involves, for GST purposes, supplies being made for non-monetary consideration, claimants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

11. This offer is made by the Promoter and not by ACP Magazines Ltd (ACP), publisher of Dolly magazine. ACP Magazines will not be held liable for any failure of the Promoter to honour or fulfill the special reader offer. All offers are subject to the normal business guidelines of the Promoter and the Participating Stores.

12. If for any reason any aspect of this offer is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the offer, or invalidate any affected claims.

13. All claims will be the property of the Promoter. The information claimants provide will be used by the Promoter for the purpose of conducting this offer. The Promoter may disclose claimants’ personal information to its contractors and agents to assist in conducting this offer or communicating with claimants. If the claimant has marked the “opt-in” box on the offer coupon, the claimant consents to the storage of their personal information by Priceline Pty Ltd (Priceline) on Priceline’s database and Priceline may use this information for future promotional and marketing purposes regarding Priceline’s products including contacting the claimant via electronic messaging. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Claimants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
