1. Information on how to enter forms part of these terms and conditions of entry.
2. Entry is open to residents of Australia only. Employees of the Promoters (and their immediate families) and agencies associated with this promotion are ineligible to enter. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoters to enter into a further agreement as evidence of consent to this promotion.
3. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoters). Where relevant, the Promoters is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoters is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
4. There are two methods of entering:
Entry method 1 - To enter, go to www.rougemag.com.au/herbal and follow the prompts to the reader survey. Complete the reader survey and your contact details as instructed and tell us in 25 words or less “What is your ultimate tropical experience?”

Entry method 2 - To enter, go to www.cosmopolitan.com.au/summer and follow the prompts to the reader survey. Complete the reader survey and your contact details as instructed and tell us in 25 words or less “What is your ultimate tropical experience?”
Participants must fill out, in full, all mandatory elements of the reader survey, contact details including name, date of birth, contact phone number, address, and current email address and answer to competition question “what is your ultimate tropical experience” (in 25 words or less), for their entry to be valid in the judging.
5. The promotion commences 00:01am, AEDST 02 January, 2012, and closes at 11:59pm, AEDST 1 April, 2012. The promotion will be judged by a panel of judges appointed by the promoters. Judging will begin on 16 April, 2012 at 11.00am at the ACP Magazines premises, 54 Park Street, Sydney NSW 2000. The winner will be notified by telephone and in writing using the contact details given in their entry. The name of the major prize winner will also be published in The Australian on 14 May 2012.
6. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
7. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
8. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
9. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter
10. The best entry (1) as deemed by the judges will be deemed the major prize winner and will win a trip for four people to Fiji. The prize includes:
Return economy flights for four (4) people to Fiji from the winner’s nearest capital city valued up to $5,500 (depending on point of departure)
Seven (7) nights’ in a two (2) bedroom Villa (standard Villa) accommodation at Sheraton Denarau Villas valued at $2982
$2,000 spending money – awarded in the form of a cheque made in favour of the winner.
Total major prize is valued at up to $10,482.
The next ten (10) best entries as determined by the judges will be deemed the runners up and will each receive:
One (1) x summer beauty prize pack from Proctor & Gamble valued at $150.
The total prize pool is valued at $11,982.
11. The major prize is subject to availability at the time of booking and blackout periods may apply. Including prize cannot be taken on Australian school holidays and public holidays. Major Prize must be redeemed in full and as a package by 16 April 2013.
12. If the major prize winner is under the age of 18 years, the winner must be accompanied by an adult or legal guardian when redeeming the prize.
13. The winner (and their companions) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
14. Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for international travel and port charges are included in the prize provided by the Promoters.
15. A credit card imprint or cash deposit will be required from the winner at check-in at the hotel for any in-room incidental charges.
16. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner.
17. The prize (or any part thereof) cannot be sold, is not transferable or exchangeable and cannot be taken for cash. No responsibility is accepted for any variation in the value of the prize.
18. A valid passport is required for all international journeys. It the responsibility of the winner and their travel companion to ensure they have all required passports and visas as required for travel.
19. Adequate travel insurance for the duration of the trip must be organised by the winner at his/her own expense. Meals or tips, transfer fees (other than specified), excess baggage and any other personal expenses not specified in the prize package must be paid for by the winner.
20. Products included in prize package (including but not limited to titles, colour, design, sizing, model, finish, style etc) will be determined by the promoter in its complete discretion. All prizes must be taken as offered.
21. If the prize or portion of the prize is unavailable, for whatever reason, the Promoters reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
22. The Promoters takes no responsibility for prizes damaged, delayed or lost in transit.
23. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer. The prize is valued in Australian dollars. The Promoters accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoters will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
24. It is a condition of accepting the prize that the winner (and any traveling companions) must comply with all the conditions of use of the prize and prize supplier’s requirements. Winner will be required to sign a liability waiver form to accept the prize.
25. Prize is subject to the standard terms and conditions of individual prize and service providers.
26. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoters, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
27. In the event that a prize, or part of a prize, is unavailable, the Promoters reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
28. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoters reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
29. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
30. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoters. Method of validation (without limitation) will be determined by the Promoters in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoters requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoters. It is a condition of accepting the prize the winner sign any such legal documentation.
31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
34. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoters reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
35. Entries remain the property of the Promoters. Details from entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoters may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the entrant.
