Terms and Conditions
1. Information on how to enter and prizes form part of these Conditions of Entry. Entries not completed in accordance with these Conditions of Entry or received after close of entry will not be considered. The promoter’s decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into. This is a game of chance.
2. Entry is only open to Australian residents who purchase the November 2011 issue of Cleo Magazine (on sale 17th October 2011) or the November 2011 issue of Dolly Magazine (on sale 12th October 2011). Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. The Promotion commences 12th October 2011 at 12:01am AEDST and final entries close 30th November 2011 at 11:59pm AEDST. Individual entry periods are listed below in table A. The draws will take place at ACP Magazines, 54 Park St Sydney NSW 2000 on the dates stipulated in Table A. All times are in AEDST. The winners will be notified in writing within two (2) business days of the draw.

4. Entrants can enter into promotion one (1) ‘Cleo’ in one of two ways:
a. Entrants (excluding VIC residents) can take a photo of the Venus advertorial page with their MMS compatible mobile phone and create an MMS using that photo, along with their full name and email address. Send that MMS to 0408547881 during the promotional period.
OR
b. Entrants who cannot send an MMS message from their mobile phone (and all VIC residents) can send an SMS with their full name and email address to 0408547881 during the promotion period.
Entrants can enter promotion two (2) ‘Dolly’ in one of two ways:
c. Entrants (excluding VIC residents) can take a photo of the Venus advertorial page with their MMS compatible mobile phone and create an MMS using that photo, along with their full name and email address. Send that MMS to 0409064903 during the promotional period.
OR
d. Entrants who cannot send an MMS message from their mobile phone (and all VIC residents) can send an SMS with their full name and email address to 0409064903 during the promotion period.
5. Victorian residents are not permitted to enter via MMS. All Victorian entries must be submitted via SMS. Any entry received from a Victorian resident via MMS will not be accepted.
6. Multiple entries permitted, however each entry must be submitted separately and in accordance with entry requirements.
7. Incomplete, illegible and incomprehensible entries will be deemed invalid. Any photo that is partially incomplete or obscured or that does not show the whole promotional page may be deemed invalid at the discretion of the Promoter.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s/winner’s identity, age, place of residence and/or, if necessary, relevant phone bills to determine identification) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS/MMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. The MMS entry mechanism is only open to consumers with an MMS compatible mobile phone connected to a service provider which permits picture messaging to the promotional numbers. It is recommended that entrants check with their individual service provider before entering via MMS. Entrants under 18 years old must obtain account holder’s consent prior to sending a SMS/MMS. This is not a premium rated service and standard messaging and data rates apply. Entry costs will vary depending on the mobile network used. The cost of SMS messages will not exceed 55 cents each. Standard MMS rates apply. If necessary SMS and MMS winners may be contacted by SMS and/or phone and/or email and the Promoter will record their address details so that the prize may be awarded. Entries are deemed to be received at the time of receipt by the Promoters and NOT at the time of transmission by the entrant.
10. The promoter is neither responsible nor liable for late, lost, misdirected, incomplete or inaudible entries.
11. The first thirty (30)valid entries drawn in promotion one (1) for ‘Cleo’ readers will each win:
o One (1) summer bikini pack consisting of: one (1) x Aztec Rose bikini (valued at $79.95, in either ‘Macchu Picchu Balconette’ style as featured on the creative OR one (1) of three (3) other varying styles) and one (1) x Moontide bikini (valued at $139.98, in either ‘Boob Job’ style as featured on the creative or one (1) of three (3) other varying styles). Each summer bikini pack is valued at $219.93. The total prize pool for summer bikini packs awarded in promotion one (1) is valued at $6,597.90.
12. The first three hundred (300) valid entries received in promotion one (1) for ‘Cleo’ readers will each be awarded with:
o One (1) Venus bikini trimmer, valued at $6.99. The total prize pool for all bikini trimmers awarded in promotion one (1) is valued at $2,097.00.
13. The total prize pool for promotion one (1) for ‘Cleo’ readers is valued at $8,694.90.
14. The first thirty (30) valid entries drawn in promotion two (2) for ‘Dolly’ readers will each win:
o One (1) summer bikini pack consisting of: one (1) Heaven Swimwear bikini (valued at $64.99) and one (1) x Aqua Blu bikini (valued at $99.00). Each summer bikini pack is valued at $163.99. The style of bikini will be either one of the two Heaven Swimwear bikinis featured on the creative and either one of the two Aqua Blue bikinis featured on the creative, or one (1) of three (3) other varying styles from each brand. The total prize pool for summer bikini packs awarded in promotion two (2) is valued at $4,919.70.
15. The first three hundred(300) valid entries received in promotion two (2) for Dolly’ readers will each be awarded with:
o One (1) x Venus bikini trimmer, valued at $6.99. The total prize pool for all bikini trimmers awarded in promotion two (2) is valued at $2,097.00.
16. The total prize pool for promotion two (2) for ‘Dolly’ readers is valued at: $7,016.70.
17. All prizes are subject to availability and must be redeemed in full by19th March April 2012. In the event that for any reason whatsoever the prize is not redeemed by this date, the prize will be forfeited by the winner.
18. Products included in a prize package (including but not limited to titles, colour, design, sizing, style, brand, etc) will be determined by the Promoter in its complete discretion.
19. All prizes must be taken as offered. Prizes, or any unused portion of a prize, is not transferable or exchangeable and cannot be redeemed as cash. Prizes are not valid in conjunction with any other offer. Prizes are valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of a prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
20. By entering the promotion via SMS or MMS an entrant consents to the Promoter using their personal details for the purposes of sending one (1) mobile terminated (MT) reply message which includes a confirmation of their entry in the promotion and to be used to contact the entrant if required for any reason in relation to their promotion entry.
21. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on the winner’s behalf. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to any administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
22. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value, subject to any directions from a regulatory authority.
23. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
24. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize.
25. The Promoter may conduct such further draws at the same time and place as the original draw as are necessary at 11am AEDST on Tuesday 20th March 2012 in order to distribute any prize that remain unclaimed by that date, subject however to all reference to any relevant state and territory regulations. In the event of a winner in the unclaimed prize draw, the winner will be notified in writing within two (2) business days of the draw.
26. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
27. If an entry is selected as a winning entry, validation of the entrant’s circumstances/ the validity of their entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the Conditions of Entry herein. It is a condition of accepting a prize that a winner sign any documentation required by the Promoter.
28. Entrants must ensure that all care is taken when sending messages to the promotional number(s). It is the complete responsibility of the entrant to ensure that they SMS/MMS the correct number, in the event that an error occurs the Promoter accepts no responsibility for either, costs incurred, responses received or all other consequences. This is the responsibility of the entrant.
29. The Promoter accepts no responsibility for any SMS/MMS messages not received by the Promoter or delays in the delivery of the SMS/MMS message due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from an entrant’s mobile phone handset.
30. SMS and MMS entries via the internet are not valid and will not be accepted. The use of any automated entry software or any other mechanical or electronic means that permits an entrant to automatically enter repeatedly are not valid and will not be accepted.
31. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
32. If for any reason this promotion is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the promotion.
33. All entries become the property of the Promoter. The collection, use and disclosure of personal information in connection with this promotion are governed by the Promoter’s Privacy Notice available from ACP Magazines and these Conditions of Entry. The Promoter may use information it collects to provide entrants with information regarding further offers, promotions or goods and services provided by the Promoter and/or the Promoter’s partners and sponsors. The Promoter may also disclose information about entrants to its service providers to enable the Promoter to provide them with services.
34. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the promotion and/or (g) redemption of a prize. To the full extent permitted by law, The Promoter will not be liable in respect of any claim for any loss or damage whatsoever (including, without limitation, any consequential, indirect, special, punitive or incidental damages) or for any personal injury suffered by an entrant as a result of or in connection with the Promoter’s provision of the service. Certain legislation may imply warranties or conditions or impose obligations (collectively “Provisions”) in relation to the Promoter’s provision of services to an entrant which cannot be excluded, restricted or modified except to a limited extent. If those Provisions apply, to the extent that the Promoter is entitled to do so, the Promoter’s limits its liability in respect of any claim under those Provisions to, at the Promoter’s option, the supply of the relevant services again or the payment of the costs of having the services supplied again.
